Welcome to Hola Asia, the employment platform dedicated to connecting employers with candidates in the Asian labor market. By registering and using our platform, you agree to the following Terms and Conditions. If you do not agree with these terms, you must not use our services.

1. General Information

“Hola Asia” is an employment platform that allows employers to post positions and candidates to apply for available job openings. Access to and use of our platform is subject to these Terms and Conditions and our Privacy Policy, which governs how we treat your personal data.

2. Account Registration

To fully access the Platform and its features, you may need to create an account. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.

3. Job Listings

As a User, you may have the ability to post job listings on the Platform. You agree that all job listings you post will be accurate, lawful, and comply with applicable laws and regulations. You are solely responsible for the content of your job listings and any consequences arising from posting inaccurate or misleading information. You respect applicable local and international laws, including those related to the protection of personal data and non-discrimination in employment.

You will not publish content that is offensive, discriminatory, defamatory, or infringes the intellectual property rights of third parties. You will not interfere with or manipulate the platform's operation in any way that may affect its integrity or accessibility for other users.

4. Job Applications

As a User applying for jobs through the Platform, you agree to provide accurate and truthful information in your application materials.  Hola Asia is not responsible for employers' hiring decisions on the Platform. We do not guarantee the accuracy or authenticity of job listings, and we encourage Users to exercise caution and conduct their own due diligence.

5. User Content

The Platform may allow you to post, submit, or upload content, including but not limited to resumes, cover letters, and job listings ("User Content"). You retain ownership of your User Content, but by providing it to us, you grant Hola Asia a worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform's operation and promotion.

6. Prohibited Activities

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform's functionality. You also agree not to engage in any of the following prohibited activities:

  • Use the Platform to post false, misleading, or fraudulent information.
  • Harass, intimidate, or threaten other Users or Hola Asia personnel.
  • Attempt to gain unauthorized access to the Platform or other Users' accounts.
  • Use automated means, including bots, spiders, or scrapers, to access the Platform or collect User information.
  • Violate any applicable laws, regulations, or third-party rights.
  • Users are not entitled to copy, reproduce, distribute, or modify any content on the platform. All content, design, logos, trademarks, software, and other materials related to the “Hola Asia” platform are the property of Hola Asia or its licensors and are protected by intellectual property laws.

7. Privacy

Your privacy is important to us. Hola Asia is committed to protecting user privacy and complying with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP). Please review our Privacy Policy to understand how we collect, use, and disclose information about our Users.

8. Modifications to the Platform

Hola Asia reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may also impose limits on certain features or restrict your access to parts or all of the Platform without liability or notice.

9. Fees and payments

Access to the platform is free for candidates. However, employers must pay fees to post job openings or opt for premium services that improve the visibility of their ads. Stripe is used as the payment gateway. Payment will be processed exclusively through the payment methods available on the platform. Employers must ensure that the billing information provided is accurate and up to date.

10. Marketing and email communications

By registering and using Hola Asia, both employers and candidates agree that we may send them electronic communications related to the platform, such as updates, job postings, newsletters, promotions, and other content.

11. Indemnification

You agree to indemnify and hold Hola Asia, its affiliates, officers, directors, employees, agents, and representatives harmless from and against any claims, damages, liabilities, losses, and expenses arising out of your use of the Platform, your User Content, or your violation of these Terms.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,  HOLA ASIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflicts of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mexico.

14. Changes to the Terms

 Hola Asia may update these Terms from time to time. Any changes will be posted on this page, and the "Effective Date" at the top will reflect the most recent revision. Your continued use of the Platform after the revised Terms are posted constitutes your acceptance of the changes.
